Terms of Use
These terms govern your use of CharmCue, including its AI features, keyboard, subscriptions, and support services.
1. Provider and acceptance
CharmCue is provided by Ümit Duran, trading as Vebesto Studio, Germany (“we”, “us”, or “CharmCue”). By downloading or using the app, you agree to these terms and the Apple Standard Licensed Application End User License Agreement. If these terms conflict with mandatory App Store terms, those mandatory terms apply.
2. Eligibility
Eligibility: you must be at least 18 years old and legally able to enter a contract. Do not use CharmCue if local law does not permit you to use the service.
3. License and ownership
We grant you a personal, limited, revocable, non-exclusive and non-transferable license to use CharmCue on Apple devices you own or control, subject to Apple’s usage rules. CharmCue, its design, software and branding remain owned by us or our licensors.
You retain rights in content you submit. You give us and our service providers a limited permission to process that content only as needed to operate, secure and improve the requested service and meet legal obligations.
4. AI features and your responsibility
AI limitations: CharmCue generates suggestions using artificial intelligence. Output may be inaccurate, inappropriate, repetitive, biased, or unsuitable for your situation. It is not professional, legal, medical, safety, or relationship advice and does not guarantee a response or outcome.
You are responsible for reviewing every suggestion before sending it and for your communications, decisions, permissions and consequences. Do not rely on CharmCue in emergencies, for coercive behavior, or for decisions that may cause harm.
5. Acceptable use
Acceptable use requires you to respect other people, their privacy, and applicable law. You may not use CharmCue to:
- harass, threaten, deceive, stalk, exploit, discriminate against, or impersonate anyone;
- submit content you do not have the right to process, including unlawfully obtained private conversations;
- generate sexual content involving minors or facilitate abuse, exploitation, violence, fraud, or illegal activity;
- probe, overload, reverse engineer, resell, automate, or bypass the app’s access, security, rate, or premium controls.
6. Premium subscriptions
All AI-generated analysis and suggestion features require an active premium entitlement. Available subscription options may include:
- a one-week recurring subscription with no free trial;
- a one-year recurring subscription that may include a three-day free trial for eligible customers;
- a separate one-year welcome offer, when shown in the app, that may also include a three-day free trial for eligible customers.
Trial eligibility is determined by Apple and may be limited by your previous introductory-offer use. Unless cancelled, an eligible trial converts to the full annual price shown on the App Store purchase sheet. Prices, taxes, currencies, eligibility and offer availability can vary by storefront. The paywall and Apple purchase sheet shown immediately before confirmation are authoritative.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period, subject to Apple’s applicable rules. Apple charges and manages the purchase through your Apple ID. You can cancel or use Manage Subscription in your Apple subscription settings. Cancellation keeps premium access until the end of the current paid period; it does not normally create a refund.
If access is missing after reinstalling or changing devices, use Restore Purchases in CharmCue. Refund requests and billing disputes are handled under Apple’s policies.
7. Unlimited use and service protection
Premium is described as unlimited for normal, personal use. This does not permit automated, commercial, abusive, fraudulent, technically excessive, or security-threatening use. We may apply reasonable concurrency, rate, safety and abuse-prevention controls to protect the service and other customers.
8. Availability and changes
We aim to keep CharmCue available but do not guarantee uninterrupted or error-free operation. Features may depend on Apple, Firebase, Google Gemini, RevenueCat, an internet connection, device permissions, and third-party apps. We may change, repair, suspend or discontinue features when reasonably necessary.
9. Privacy
Our Privacy Policy explains how selected messages, screenshots, anonymous identifiers, stored results and subscription data are processed. You are responsible for respecting third-party privacy when submitting a conversation or image.
10. Termination
Termination: you may stop using and delete the app at any time, but deleting the app does not cancel a subscription. We may suspend or terminate access when you materially breach these terms, create security or legal risk, abuse the service, or when required by law. Where reasonable, we will consider the severity and provide notice or an opportunity to remedy.
11. Disclaimer
Disclaimer: to the extent permitted by law, CharmCue is provided “as is” and “as available”. We disclaim implied warranties that can legally be disclaimed, including fitness for a particular purpose and that AI output will achieve a desired personal result. Nothing here excludes statutory guarantees that cannot be excluded.
12. Limitation of liability
Limitation of liability: we remain liable without limitation for intent, gross negligence, injury to life, body or health, fraud, and liability that cannot be limited under applicable law. For ordinary negligence involving an essential contractual obligation, liability is limited to foreseeable damage typical for this type of service. Otherwise, liability is excluded to the extent legally permitted.
13. Governing law
These terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not remove mandatory protections or courts available under the law of your usual place of residence.
14. Changes to these terms
Changes to these terms will be published here with a revised effective date. If a material change requires consent, we will request it in the app or provide appropriate notice.
